NCAA, Pac-12 and USC seek dismissal of Reggie Bush’s lawsuit over lost NIL pay
Ryan Kartje (LA Times) — The NCAA, Pac-12 Conference and USC are seeking the dismissal of a lawsuit filed by former Trojans star running back Reggie Bush on the grounds that his claims of antitrust violations and lost name, image and likeness compensation from his Heisman-winning tenure at USC come “at least a decade and a half too late.”
Bush filed the lawsuit in September, alleging that his school, its former conference and the sport’s governing body had all “profited from uncompensated use” of his NIL during and after his dazzling tenure at USC “without compensating Bush one penny.” In a news release announcing the lawsuit, Bush’s attorneys claimed he should be paid “to address and rectify ongoing injustices stemming from the exploitation of Reggie Bush’s name, image and likeness during his tenure as a USC football player.”
But in filings this week with the Los Angeles Superior Court, attorneys for the NCAA, Pac-12 and USC set out to dismantle those claims, arguing that Bush’s “effort to wind back the clock” should be barred by the statute of limitations, which is typically four years in antitrust cases. Bush last played at USC in 2005.
“Any such claims accrued no later than 2005, meaning that his suit comes at least a decade and a half too late,” the NCAA’s attorneys wrote. “And while [Bush] gestures at several exceptions to the statutes of limitations [in his lawsuit], he offers no well-pleaded allegations showing a plausible entitlement to any of them.”
The NCAA’s attorneys argue that not only was Bush’s lawsuit filed too late, but that it’s also “legally insufficient” with “few facts at all beyond a summary of [Bush’s] playing career.”
“Such a bare-bones complaint does not suffice under California law,” the attorneys wrote.
Additionally, they claim Bush is bound by previously litigated claims against the NCAA regarding access to NIL and his place as member of a certified class in past lawsuits, including O’Bannon vs. NCAA, “makes it inexcusable for him to have waited over a decade [or] more to bring a similar claim yet again.”
USC said in a statement it was “proud of the exceptional support it offers its current and former student-athletes, including Reggie Bush, whose efforts to recover his Heisman Trophy we fully and publicly supported.”
“The claims in the lawsuit, however, date back nearly 20 years, are completely barred by the statute of limitations and, regardless, lack any legal or factual merit. USC has asked the court to dismiss these claims as a matter of law, and we will continue to defend ourselves in court.”
Bush’s legal team responded to the dismissal request by accusing USC, the NCAA and the Pac-12 of continuing to profit from Bush’s name, image and likeness.
“What’s more is that these entities have set the hearing on these motions for November of 2025 in the hopes of delaying this case, and any ruling on this matter, for 11 months,” Evan Selik, an attorney representing Bush, said in a statement. “We will continue to take the appropriate and just action to move this case forward notwithstanding USC, the NCAA and the Pac-12’s conduct.”
In suing the NCAA, Bush’s attorneys said he hoped to “pave the way for a system where athletes are rightfully recognized, compensated and treated fairly for their contributions.”
During his three seasons at USC, no college athlete in America was more recognizable than Bush, whose electric ability helped lead the Trojans to a national title in 2004 and earned him the Heisman Trophy as the best player in college football in 2005.
But in 2010, long after Bush had left for the NFL, the NCAA found that Bush and his family had accepted improper benefits during his college tenure and imposed harsh sanctions on USC, including a total disassociation from Bush, whose name and image was scrubbed completely from the school and its record books. Bush was also forced to relinquish his Heisman Trophy, as the Heisman Trust refused for over a decade to acknowledge him as one of its winners.
That changed earlier this year after a lengthy campaign from Bush and his attorneys, as the Heisman Trust reversed course on its long-standing decision. The trophy was returned in April to Bush, who immediately turned his ire to the NCAA. He vowed to fight until his records from 2004 and 2005 were reinstated, along with USC’s wins during its 2004 championship season.
“This is just the beginning of the journey to getting full justice,” one of Bush’s attorneys, Ben Crump, said at the time.
Bush’s legal team sought USC’s help in that fight this past fall. They asked that the school “get behind” Bush’s efforts to get his records reinstated and also reimburse Bush for his attorneys fees.
A few weeks later, Bush filed his lawsuit, naming the school as one of its defendants. The school found out via the news release from Bush’s legal team.
“Reggie Bush received all the accolades a college football athlete could receive during his three years playing football at USC,” the lawsuit stated. “And while Bush received the accolades, Defendants NCAA, USC, and the Pac-12 Conference received all the money.”
How much Bush is asking for in restitution from the three defendants is still unclear. In an interview with The Times, one of Bush’s attorneys said experts told him USC made “hundreds of millions” off of Bush during his tenure as a Trojan. But the topic of back NIL pay had never been broached with USC before the lawsuit was filed. And the complaint itself is largely devoid of specifics as it relates to revenue or NIL estimates.
As part of the lawsuit, Bush’s legal team did request a trove of documents, according to court filings, including revenue figures from jersey sales, video games sales and TV deals, as well as any communication between the NCAA, USC, Pete Carroll or the Heisman Trust. Attorneys for the defendants dismissed the request for documents as “needlessly burdensome.”
The legal teams on both sides of Bush’s lawsuit met last week via videoconference to discuss the complaint and hash out their differences. But no agreement could be reached, according to court filings.

There is a lot of blame to lay at LR’s feet. But that is only part of the story. Unfortunately we are not getting any reporting from all of the people who cover USC. The gang at On3/WEARESC never tell us why anyone decided to enter the portal. Lack of playing time?, NIL? Homesick?, etc.. And the same goes for all of the other Trojan insiders. They regurgitate what Heritage Hall feeds them. None of the “reporters” will report anything that will jeopardize their access to the coaches or players. And the reporters of the newspapers are marginally better.

This is becoming a full-fledged abandoning of the ship. The kids are obviously talking among themselves and reading what the outside is saying. Lots of voices in their ears. I have worked at companies in which certain economic downturns, managerial decisions, or upper management turnover fostered poor employee morale that triggered mass exoduses. I do believe USC football has now sunk to the lowest I have ever witnessed. Maybe this is an overreaction to our situation because we simply have so much more access to program info on a minute-to-minute basis than ever before. That’s surely plausible. But I recently asked the TDB for any examples of a worse time in our football history. Someone suggested the ’40s and ’50s. With the continued news of good players leaving SC for whatever reasons (probably poor development on the offensive side of the ball), it feels like like our once great program is now a sizable shit-turd rolling down a big hill in the cow pasture, gaining size and speed as the program heads toward oblivion. Reggie Bush NEVER made a good faith effort to cover USC’s “six”. We continue to discuss this Greek tragedy as it was the SEMINAL event which led to the NCAA’s “death penalty” against USC. Kinda on the fence about this transfer. I’m sure he was getting a good chunk of NIL money and from what I witnessed on the field, USC was not getting its money’s worth. Not sure if it was due to coaching, sophomore slump, etc…we all saw the talent as a freshman but the production just wasn’t there as a sophomore. Case in point, when Makai replaced Branch on kickoffs, the teams kickoff return production seemed to get a better…maybe a change of scenery will bring out Branch’s potential…
This is just more of the same issue where players are not getting the playing time they think they deserve. However with Zach B maybe he didn’t get what he expected but when he did get out there, he sure didn’t produce. He was fair catching everything on kicks and punts and as a WR he had the dropsies. It’s disappointing to see this happen as he has so much potential but many players do not reach their potential due to inflated self worth and heads like granite and don’t listen. Here’s a thought. Last year….going into every game we felt that in one area of the game we had a definite advantage…….between Duce, Branch and Hudson….. that appears to be gone. The room still has some talent but overwhelming……no Since Jen has not made a move it’s apparent that we are stuck with you know who for 2025. As Parcelman007 pointed out……quite a few of the newer coaches at other programs are getting it done……what we get are excuses, misdirection and stupidity. I’m hoping Riley will leave, as he has failed miserably at SC. If he just stays for $$$, the we are doomed for 7 or so more years of irrelevance. Add in Helton’s time and we have twenty years of this. That will be a very difficult program, at that point, for anyone to revive it. The mediocrity has destroyed SC football, not to mention NIL, and free agency. And we paid Riley some $10 million a year for this!!!!
With what few receivers we have left if might be a good idea to keep the WR coach. I doubt the defense coaches are going anywhere.

LR is destroying this program. He’s lost the team. The players don’t believe in him anymore(they once did) and the coaches are trying to get off this sinking ship. The fans also want him gone. I still say what I said before. I wouldn’t be surprised to see him find a way to make a deal so that he himself can get off the ship. The thing is for Riley, if he bails, then I would think his HC career is over. That would be the worst resume ever. I see him sticking around and “trying” to turn it around so he can claim he “rebuilt” it. I just have serious doubts that he can do it.

Zach Branch dropped as many passes as he caught and made some really bad choices as a ball carrier. I loved him his first year, but he hasn’t shown much since.

Nothing is ever mentioned about USC losing bowl game revenue as a result of the NCAA sanctions against it due to Bush and his family’s actions. The scholarships lost and recruiting impact has been felt for many years. While I enjoyed watching him play football, Bush is a disgrace to USC. He’s never publicly apologized to the players, coaches, alumni, and fans for what he did and still insists he did nothing wrong based on today’s rules. Until an apology is made, I won’t support him in any way.
Reggie Bush left USC to clean up his mess with the NCAA. He could have simply stroked a check to Lloyd Lane to prevent him from providing NCAA any info. Instead of cutting a check for $300K to Lane, he hosted lavish parties in Vegas far exceeding $300K. He sued the St Louis Rams and won a $11M judgement. I read that Reggie did try to settle with Lake and Lake refused. Maybe Lake thought he could make a name for himself. I don’t know. Reggie went to USC and knew what the rules were at the time. Times change, some of it because of Reggie. Doesn’t entitle him so something he doesn’t deserve. Reggie made his dough. Make the most of it man and move on with your life. You have a great life. Reggie you have a lovely wife of 10 years and 3 healthy kids. Do something positive.

Reggie could have offered Lake 10 cents on the dollar and claimed he “tried to settle.” Lake was forced to take Reggie to court, which he did, to recover his money. Reggie appears to like litigation, as others here have suggested.
From what I read I thought he tried to give him the $300K Lake wanted. I don’t know for sure. Man, it’s been 20 years. Let’s all move on to the present.
Why would Lake ever turn down the $300K he always insisted he was owed in the first place, forcing himself into court to recover? Never happened, that’s why.

They plucked a choice receiver from the portal and the head coach is in the paper decrying the portal dates because his backup quarterback is entering the portal before the bowl game. Even though I agree the portal shouldn’t open before the end of the season, I guess the date has something to do with college registration deadlines.
Penn St should go as far as the semifinal game, outside chance to the final. That backup QB may wish he could have stayed another month. But I guess to get registered at the new school to play in the spring they gotta go now.
Penn St only has 4 out going transfers including an unrated WR and now they get a very good one from USC.

Someone over on the Daily Norseman site suggested that Darnold had trouble locating his receivers due to the white helmets. Maybe nothing to it, but does makes sense, especially with so much other white in the building last night. Wonder if they ever practiced with white helmets, doubt it.

I don’t know if Darnold was affected, but he unfortunately showed why some people question his NFL starting ability, especially on that horrible pick which was a classic example of a backfoot ball that should have been thrown away.
Both USC QBs were clearly off, but it’s still great to see two Trojan QBs dueling each other in the NFL.

Absolutely. UCLA always advertises that Troy Aikman won Super Bowls for the Dallas Cowboys, but no USC QB has ever done so for the Trojans. With this, Bush highlights his long love for the university he was associatyed with. Great football player, but he was just in it for money, he embarrassed his school with his legal, outside journey for money. Now he seeks mo’ money and sues the University that enabled him to have a NFL future. He is a disgrace and should have his jersey taken down and his Heisman returned.
I simply don’t know what makes Reggie tick these days. A lot of what you say rings true for me, and when he recently demanded that USC pay his attorney fees, he lost me for good. According to “Celebrity Net Worth” Sept. ’24, Bush has a net worth of $25 million, has a $5.65 million mansion in Encino, wife and 3 kids. He also does charity work. I could see him trying to get his records and USC records reinstated but this looks like a bad way to do it. He should be thankful for his many blessings and move on with his life.
A question is always just how much debt does he have on that house, or otherswise. Reggie was never seen as a gambler or tossing money around, so I wonder what’s behind his actions. He really is burning his past and one has to ask “why.”
Bush refused to help USC when the NCAA was trying to put USC in a lifetime penalty box. All he ever said was, “I did nothing wrong,” over and over when he could have gone to bat hard for Todd McNair and the Trojans, but he didn’t per every ounce of coverage I have read or observed on the subject. “I did nothing wrong” could mean a lot of things, and based on his lawsuits against the Pac-12, NCAA and USC, Bush always felt he deserved to be getting overtly paid while playing for USC anyway. It’s as though Reggie thinks he won the Heisman by himself. He just doesn’t understand how much USC helped make him the #2 pick in the Draft. Then he turned out to be a solid, but never great pro.
